Constitution of the American Legion Riders of Colorado
PREAMBLE
For God and Country, we associate ourselves together for the following purposes:
To uphold and defend the Constitution of the United States of America; to maintain law and order; to foster and perpetuate a one hundred percent Americanism; to preserve the memories and incidents of our associations in the great wars; to inculcate a sense of individual obligation to the community, state and nation; to combat the autocracy of both the classes and the masses; to make right the master of might; to promote peace and good will on earth; to safeguard and transmit to posterity the principles of justice, freedom and democracy; to participate in parades and other ceremonies, that are within the aims and purposes of the American Legion and to promote motorcycle safety.
ARTICLE I
NAME AND PURPOSE
SECTION 1. Name: The name of this organization shall be the AMERICAN LEGION RIDERS of COLORADO.
A. The name American Legion Riders of Colorado may only be used in any form by this corporation within the Department of Colorado.
SECTION 2. Address: The headquarters of this organization shall be located at the AMERICAN LEGION DEPARTMENT HEADQUARTERS 7465 E. 1st Ave., Suite D, Denver, Colorado 80230
SECTION 3. Purpose: AMERICAN LEGION RIDERS of COLORADO is a non-profit charitable corporation registered within the state of Colorado. Its purpose is to participate in parades and other ceremonies that are within the aims of the American Legion, to promote motorcycle safety. To promote a social atmosphere for the American Legion family member, and to use our programs to support other motorcycle organizations and most of all our veterans, veterans homes and hospitals. Also, to keep alive the memory of our POW’s and MIA’S.
SECTION 4. The AMERICAN LEGION RIDERS of COLORADO is a non-partisan organization and shall not be used for dissemination of political principles or candidacy of any person seeking public office or preferment.
SECTION 5. Dissolution: Upon the dissolution of the AMERICAN LEGION RIDERS of COLORADO, assets shall be distributed to the American Legion, Department of Colorado, 7465 E. 1st Ave.,

Suite D Denver, Co 80230 for one or more exempt purposes within the meaning of section 501 (c) (3) of the IRS code, or the corresponding section of any future federal tax code, or shall be distributed to the federal government for a public purpose. Any such assets not so disposed of shall be disposed by a court of competent jurisdiction of the county in which the principal office of the corporation is then located, exclusively for such organization or organizations as said court shall determine which are organized and operated exclusively for such purposes.
ARTICLE II
ORGANIZATION
SECTION 1. Corporation Board of Directors: The administrative power of the AMERICAN LEGION RIDERS of COLORADO shall be vested in the CORPORATE BOARD MEMBERS, which will be comprised of 1 active member of the AMERICAN LEGION RIDERS of COLORADO from each district where a rider group is located. Each elected board member shall serve a term of 2 years. If such term cannot be fulfilled due to unforeseen circumstances a special election will be held in that district. Corporate board members must be American Legion members in good standing with their Post.
SECTION 2. Board of Directors Officers: The Board of Directors shall consist of a President, Vice President, Secretary, Treasurer and Sergeant of Arms, elected from the corporate board members from each district. The Adjutant of the American Legion Department of Colorado and the Department of Colorado Financial Office.
A. Any officer on the Board of Directors, that may have any control over or access to funds, needs to be bonded.
SECTION 3. Term of Office: The term of the officers of the Corporate Board shall be 1 year with an election being held by the Corporate Board at yearly meeting.
SECTION 4. The year will be comprised of the calendar year January 1 thru December 31.
ARTICLE III
FINANCE
SECTION 1. Source of Revenue: The revenue shall be derived annually from the districts at a rate to be determined and other sources approved by Corporate Board Members. These funds can be used to aid the districts, to pay travel expenses for Corporate Board Members to annual meeting to aid veterans, veteran homes or hospitals.
SECTION 2. Financial Records: All bookkeeping and accounting for State American Legion riders will be kept by The American legion Department of Colorado. Monthly financial statements and annual audit under the direction of the American Legion, Department of Colorado.
SECTION 3. Signatory: The Department Finance Officer, Department Adjutant and American Legion Rider State corporate Board President will be signature to the state Legion Riders accounts. The actual check books and records of the corporation shall be physically maintained at the American Legion Department Headquarters.

ARTICLE IV
MEMBERSHIP
SECTION 1. Eligibility: Regular membership shall be open to any verified member of The American Legion, American Legion Auxiliary, and Sons of the American Legion, and meet the following requirements:
A. Must be a registered owner of a street legal motorcycle, have a motorcycle endorsement on their driver’s license or a motorcycle learners permit and insurance.
B. Spouses, who meet the requirements of Section 1, may also be members.
C. Membership of an American Legion Rider of Colorado shall not be revoked, who has to relinquished ownership or ridership of a qualifying motorcycle as a result of disability, injury, medical condition, death or death of a spouse.
D. Must have been a member for a period of time to be determined by their respective district.
SECTION 2. Membership Applications: Application for membership must be made in writing and presented at a meeting in the district in which you are applying and shall be accompanied by proof of eligibility.
SECTION 3. Expulsion: Any member of a district may be expelled for cause by a two-thirds vote of the district board members after charges are preferred under oath and in writing and a fair trial had upon the same with right of appeal.
SECTION 4. Attire: American Legion Riders being a unique entity of the American Legion and a program there of will be uniform in their appearance and dress. The following items must be uniform:
A. Vests: All vests will be either black or brown leather, black or blue denim. B. Patches: See attached diagram
C. Headgear: The recognized headgear for official functions for the American Legion Riders will be the black beret and/or black ball caps with the American Legion Riders emblem or any American Legion authorized cap.
D. Nothing will be higher on your vest than the American Flag.
E. Any patches that a member chooses to wear may not promote any political party or candidate.
F. Members shall be reminded that their vest represents the American Legion. So, any patches that are worn are of their free speech.

ARTICLE V
AMENDMENTS
SECTION 1. This constitution may be amended at any regular meeting of the American Legion Riders Corporate Board provided the board members have been notified of the proposed amendment changes thirty days in advance of said meeting.


ARTICLE VI
CORPORATE BOARD
SECTION 1. All members of the CORPORATE BOARD must be AMERICAN LEGION members.
SECTION2. All CORORATE BOARD meetings will be run by Roberts Rules of order.
